Latest news for DUIs; Articles 15 Published Aug. 23, 2007 By the 319th Air Refueling Wing Legal Office GRAND FORKS AIR FORCE BASE, N.D. -- Below are disciplinary infractions and discharges through July. Discharges An airman basic from the 319th Mission Support and Services Squadron received a general discharge for minor disciplinary infractions. An airman basic from the 319th Maintenance Squadron received an honorable discharge for mental disorders. Articles 15 (non-alcohol related) An airman first class from the 319 MXS received an Article 15 for disrespecting a senior NCO. Specifically, the member blatantly ignored orders from a senior NCO when told to participate in a foreign object debris walk. The member then proceeded to ignore the senior NCO when instructed to stand at the position of attention. The punishment consisted of a reduction to airman and a reprimand. Articles 15, courts and civilian convictions (alcohol-related) July 7 - Airman first class from the 319th Aircraft Maintenance Squadron: The member was pulled over by the Grand Forks Police Department and charged with driving under the influence. The member pled guilty downtown, received a $501 fine and 12 days in jail (six days suspended pending an evaluation and no further criminal activity). The unit offered an Article 15 for dereliction of duty (underage drinking). The punishment consisted of a reduction to airman, forfeiture of $392 pay, restriction to the limits of Grand Forks AFB for 14 days and 14 days extra duty. July 12 - Technical sergeant from the 319th Air Refueling Wing: The member was pulled over by the Larimore Police Department and charged with DUI. The unit served the member with an Article 15. The punishment consisted of a reduction to staff sergeant, 45 days extra duty and a reprimand. (Member was also removed from the master sergeant promotion list.) July 14 - Senior airman from the 319 MXS: The member was pulled over on base and charged with DUI. The unit served the member with an Article 15. The punishment consisted of a reduction to airman first class, forfeiture of $864 pay per month for two months (suspended for six months), restriction to the limits of Grand Forks AFB for 30 days and 30 days extra duty. July 21 -Airman from the 319 AMXS: The member was pulled over by the North Dakota Highway Patrol and charged with DUI. The unit served the member with an Article 15. The punishment consisted of a reduction to airman basic, restriction to the limits of Grand Forks AFB for 45 days and 14 days extra duty. July 28 - Airman from the 319 AMXS: The member was pulled over by the Red Lake County Sheriff's Department and charged with DUI. The member was also pulled over in 2006 in Red Lake County. The member entered a guilty plea to 3rd degree DUI. The member received the following sentence: one year in jail, suspended for six years; six years supervised probation, $682 fine, 45 days in jail, member must have a chemical dependency evaluation ($130 fee), and attend a victim impact panel ($50 fee). Conditions of the member's probation are: no possession or consumption of alcohol, no bars, random drug and alcohol testing, searches of person, vehicle and residence, must drive with valid license and insurance, no alcohol related incidents, and refrain from any further misconduct. All of these conditions of probation are in effect for six years. Court-Martial Senior Airman Michael Newton, assigned to the 319 MXS, pled guilty and was convicted of one charge and four specifications of false official statements, one charge and specification of larceny, and one charge and specification of frauds against the United States by a military judge in a special court-martial. Specifically, the member falsified his application and authorization to start, stop or change basic allowance for quarters. The total dollar amount of the theft was approximately $28,000. The member also falsified and submitted a fraudulent travel voucher. The adjudged sentence was 10 months confinement, reduction to airman basic and a bad conduct discharge.
