The Judge's Bench: December court-martial and article 15's

GRAND FORKS AIR FORCE BASE, N.D. --  The following members of the 319th ARW were punished under the Uniform Code of Military Justice (UCMJ) in December 2010.

Court-Martial
· SrA Jason A. Stewart was tried in a Special Court-Martial 20 December 2010, by military judge alone. He pled guilty and was convicted of wrongful use and distribution of cocaine, wrongful use and distribution of oxycodone, and wrongful use of hydrocodone-acetaminophen. SrA Stewart was sentenced to a bad conduct discharge, six months confinement, one month of hard labor without confinement, forfeiture of $500.00 for six months and reduction to the grade of Airman Basic.

Nonjudicial Punishment Actions
· A SSgt from the 319 AMXS received an Article 15 for the destruction of non-military property (keying another person's vehicle). The following punishment was imposed: Reduction to the grade of Senior Airman (suspended for six months) and a reprimand.

· An A1C from the 319 AMXS received an Article 15 for underage drinking and assault. The following punishment was imposed: Reduction to the grade of Airman, forfeiture of $811.00 pay per month for two months (suspended for six months) and 30 days extra duty (also suspended for six months).

· An A1C from the 319 CES received an Article 15 for drunk driving. The following punishment was imposed: Reduction to the grade of Airman Basic and 30 days extra duty.

· An A1C from the 319 CES received an Article 15 for underage drinking and drunk and disorderly conduct. The following punishment was imposed: Reduction to the grade of Airman Basic, 30 days extra duty and restriction to Grand Forks Air Force Base for 30 days.

· A SrA from the 319 CES received an Article 15 for failure to go to his appointed place of duty and for being incapacitated for duty due to prior consumption of alcohol. The following punishment was imposed: Reduction to the grade of Airman First Class.

· A SrA from the 319 CES received an Article 15 for stealing an identification card, credit card and checkbook of another. The following punishment was imposed: Reduction to the grade of Airman Basic, 30 days extra duty and restriction to Grand Forks Air Force Base for 30 days.

· An Amn from the 319 SFS received an Article 15 for underage drinking, providing alcohol to minors and assault. The following punishment was imposed: Reduction to the grade of Airman Basic, forfeiture of $723.00 pay (suspended for six months), 30 days extra duty, restriction to Grand Forks Air Force Base for 30 days and a reprimand.

· A SrA from the 319 SFS received an Article 15 for failure to go to his appointed place of duty. The following punishment was imposed: Reduction to the grade of Airman First Class (suspended for six months), 15 days extra duty and a reprimand.

· A SSgt from the 319 MDSS received an Article 15 for dereliction of duty for negligently failing to notice he had been overpaid Basic Allowance for Housing and Basic Allowance for Subsistence when he was not entitled to these allowances (he lived in the dorms). Furthermore, he failed to take corrective action to correct his pay. The following punishment was imposed: Reduction to the grade of Senior Airman and forfeiture of $1146.00 pay.
