The Judge's Bench: March UCMJ actions Published April 4, 2011 By 319th Air Base Wing Office of the Staff Judge Advocate GRAND FORKS AIR FORCE BASE, N.D. -- The following members of the 319th Air BaseWing were punished under the Uniform Code of Military Justice (UCMJ) in March 2011: Court-Martial · Tech. Sgt. Allen K. Hohenstein, formerly of the 319 AMXS, faced a General Court-Martial from 22 March to 26 March 2011. He was charged with several offenses involving nonconsensual sexual conduct with a teenage friend of his daughter. The panel found he had committed his offense "by using strength applied to her person sufficient that she could not avoid or escape the sexual conduct." Tech. Sgt. Hohenstein was acquitted of several lesser offenses. The panel of officer members sentenced Tech. Sgt. Hohenstein to a Bad Conduct Discharge (BCD), six months confinement and reduction to the rank of Airman First Class. Nonjudicial Punishment Actions · An Airman 1st Class from the 319th Civil Engineering Squadron received an Article 15 for failure to go to his appointed place of duty. The following punishment was imposed: 30 days of extra duties and a reprimand. · A Senior Airman from the 319th Medical Operations Squadron received an Article 15 for dereliction of duty for not properly inspecting and maintaining life saving equipment on ambulances (but annotating on official paperwork that proper inspections had been performed). The following punishment was imposed: Reduction to the grade of Airman First Class (suspended for six months) and a reprimand. · A Staff Sgt. from the 319th Security Forces Squadron received an Article 15 for making a false official statement when filing a claim for reimbursement following a TDY (he tried to obtain reimbursement for numerous taxi rides that, in fact, he did not take). The following punishment was imposed: Reduction to the grade of Senior Airman (suspended for six months) and a reprimand.
