The Judge's Bench: March UCMJ Actions Published April 4, 2013 GRAND FORKS AIR FORCE BASE, N.D. -- The following members of the 319th Air Base Wing were punished under the Uniform Code of Military Justice (UCMJ) in March 2013: Nonjudicial Punishment Actions A Senior Airman from the 319th Communications Squadron received an Article 15 for a willful dereliction of duty. The following punishment was imposed: Reduction to the grade of Airman First Class (suspended), 30 days extra duty, and a reprimand. An Airman First Class from the 319th Civil Engineering Squadron received an Article 15 for failing to go to his PT test. The following punishment was imposed: Reduction to the grade of Airman (suspended), forfeiture of $250.00 per month for two months, 30 days extra duty, and a reprimand. A Staff Sergeant from the 319th Communications Squadron received an Article 15 for failing to go to his appointed place of duty on time. The following punishment was imposed: Reduction to the grade of Senior Airman (suspended) and a reprimand. A Technical Sergeant from the 319th Civil Engineering Squadron received an Article 15 for larceny of military property. The following punishment was imposed: Reduction to the grade of Staff Sergeant (suspended), 30 days extra duty, and a reprimand. A Technical Sergeant from the 319th Civil Engineering Squadron had a portion of his suspended punishment vacated for failing to obey a lawful order. The following punishment was imposed: Reduction to the grade of Staff Sergeant. Courts-Martial Airman First Class Cody T. Nystrom from the 319th Operations Support Squadron faced a General-Court Martial on 22 January 2013 for aggravated sexual assault of a child 12 to 16 years of age, distributing, producing and possessing child pornography, using indecent language with a child under 16 years of age, making a false official statement, providing alcohol to a minor, underage drinking, and committing sodomy with a child 12 to 16 years of age. He requested and was granted a trial by judge alone, where he plead and was found guilty to all charges. A1C Nystrom was sentenced to 22 months confinement and a Bad Conduct Discharge (BCD). Major Daniel T. O'Connor, a reservist from the 934th Airlift Squadron at the Minneapolis Air Reserve Station, Minn., faced a General Court-Martial from 26 February 2013 to 1 March 2013 for the sexual assault of a person substantially incapacitated and fraternization with a Staff Sergeant. The panel of officer members found him not guilty of the sexual assault, but guilty of fraternization. The panel sentenced Maj O'Connor to a dismissal.
